Is there an argument for making the speaker liable, instead of KBOO? The performers surely were advised of FCC considerations when they agreed to broadcast of their set. This would, in my view, bolster the position that the F-bombs caught the remote crew off-guard, and did so precisely because the broadcast agreement would lead a reasonable person to believe that there would be no F-bombs. The time (after 10pm) must also be a factor.

Hi-

Thanks for your concern regarding the indeceny during the live remote, but according to the FCC if they happen after 10PM, then it's not a concern. Because we were unfamiliar with many of the bands we decided to play it safe and only broadcast after 10PM.
