Do Process...

The Council on American-Islamic Relations (CAIR) today called on Muslims and other people of conscience to ask their elected representatives to support the Due Process Guarantee Act, which would bar the military from detaining U.S. citizens without charge or trial.

The act reaffirms that American citizens suspected of terrorism and arrested inside the United States cannot be indefinitely detained by the U.S. military as is authorized by the National Defense Authorization Act (NDAA) that President Obama recently signed into law.  Obama says his administration will not authorize the indefinite military detention without trial of American citizens. However, legal experts say the president's signing statement has no legal standing and does not provide any assurance that future administrations will act in a similar manner.

 

If A Shill Tweaks In The Forest...?

Board of Forestry Chairman John Blackwell seems to be "tweaking" again.  This time it's  the Oregon Forest Practices Act which sets standards for timber harvest on state and private lands. Blackwell fears that if timber owners are regulated out of the logging business that resorts will move and - presto! - there goes the neighborhood.  Meanwhile... a study finding that logging on private timberlands is making streams warmer, potentially harming salmon, has prompted the state Board of Forestry to consider tightening state logging standards.

The study by the state Department of Forestry and Oregon State University found that state logging standards on private lands were inadequate to meet the state cold water quality standard.  To no one's surprise the study found an average increase of 1.26 degrees after logging on private lands. There was no increase on state timberlands, where more trees are left standing along streams. The temperature increases were caused by less shade thrown on the water by trees.

After hearing the study results last week, the board voted 5-2 to direct the department to start preparing new rules for protecting streamside buffers on private lands.

Board member Jennifer Phillippi, whose family owns a mill and timberlands in Southwestern Oregon, said she voted against moving forward on new regulations because the study results are not all in, and the changes in water temperature were small. Well Duuuuh. she's  timber industry.

Dave Powers, regional manager for forestry of the U.S. Environmental Protection Agency in Portland, said Washington state has for a decade had much stronger protections for streams on private timberlands than Oregon, and he expected the board to consider the issue seriously.

Ten Years After...

The Guantanamo prison camp is 10 years old this Wednesday. Ten years for wartime prisoners is unprecedented. No war in U.S. history has required that we hold prisoners even half that long. Some detainees in Guantanamo were incarcerated for so long they died of old age.

Out of an original population of more than 750 men, fewer than 175 now remain. A few of these men may ultimately be tried by a military tribunal, but most will not. In spite of Obama's now three-year-old directive to close down the camp within in a year, it looks like most of these men will languish in Guantanamo indefinitely. Until they die.

When the camp opened, the prisoners at Guantanamo had no rights at all. No right to counsel. No right to be heard. A few persistent lawyers fought to give the prisoners their basic rights, but our government resisted at every turn. Our leaders tried to justify their deprivation of rights by telling us these men were really bad, and that we were fighting a new and different kind of war. Gradually, a contrary truth leaked out.
